Legal agreements governing the use of your Payce Digital Card, Account, and Mobile App.
This Agreement is made between Cave Shepherd Card (Barbados) Inc., a company incorporated under the Companies Act Cap 308, as Company No. 37782, having its registered office at One + Haggatt Hall, Haggatt Hall, St. Michael, Barbados, trading under the registered business name Payce Digital, and the Applicant and/or any Authorised User.
1. Use of Credit Card
The Applicant shall ensure that each Card is signed immediately upon receipt and that every reasonable precaution is taken to keep each Card and its associated PIN safe. The Authorised User agrees to activate each Card upon receipt before commencing any Card use.
Any Card issued remains the property of Cave Shepherd Card and must be returned when requested. The Card may be used wherever it is accepted to make Purchases and use the PIN for ABM transactions including Cash Advances. Cave Shepherd Card shall not be liable if a Merchant does not accept the Card for any reason.
The Authorised User shall not use the Card prior to any validation date or after the expiry date. Prior to overseas travel, the Authorised User shall advise Cave Shepherd Card to avoid temporary suspension. This Agreement also applies to use of the Payce Digital Mobile App for purchases at registered Mobile Partners.
2. Credit Limit
Cave Shepherd Card shall set a Credit Limit for the Account and advise the Authorised User on the document accompanying the Card and on each monthly Account Statement. The Authorised User may request an increase in Credit Limit; Cave Shepherd Card shall assess the ability to pay before agreeing.
Cave Shepherd Card may review the Account and increase or decrease the Credit Limit without prior notice based on overall Account performance. Use of the Card and Account may be suspended if the Credit Limit is exceeded. The Authorised User agrees to immediately repay any amount in excess of the Credit Limit.
3. Loss or Theft or Unauthorised Use of Card
If the Card is lost, stolen or misused, Cave Shepherd Card must be immediately notified. Until notification, the Authorised User continues to be liable for all Debt resulting from its use. If a lost Card is subsequently found, it must not be used — cut the Card in half through the signature box and magnetic strip.
4. Compromised Cards
As a security measure, Cave Shepherd Card may deactivate the Card at any time without prior notification if suspicious Account activity is detected, or if Card data is deemed at risk of unauthorized use. Cave Shepherd Card will attempt to contact the Authorised User; if service interruption is experienced, contact customer service.
5. Liability to Debt
The Authorised User is jointly and severally liable for all Debt together with interest, service charges and fees. The Authorised User will become liable to immediately pay the total Debt if obligations under this Agreement are not carried out, or if the Authorised User becomes bankrupt, insolvent, or dies.
6. Foreign Currency Transactions
Use of the Card is subject to existing exchange control regulations by the Central Bank of Barbados. All transactions in a currency other than the Card currency will be converted based on the foreign exchange rate determined by the international service provider, plus a percentage mark-up. Visa International may charge international service fees and currency conversion fees. All foreign transactions are subject to applicable taxes.
7. Monthly Account Statements
The Authorised User shall receive an Account Statement each month detailing all Purchases and Cash Advances. Statements will be printed and mailed or emailed to registered Payce Digital Online users. The grace period will normally be thirty (30) days from the Closing Date. Where inaccuracies are believed, notify Cave Shepherd Card in writing within thirty (30) days.
8. Interest Charges and Other Charges
The Authorised User agrees to a monthly Interest Rate as outlined in the Fee Disclosure Statement. Interest is always charged on Cash Advances from the day of withdrawal. If the full Balance is paid by the Payment Due Date, no interest charge will be applied for the subsequent month. The Authorised User agrees to pay an Annual Fee as outlined in the Fee Disclosure Statement.
9. Payments
Payments shall be made on or before the Payment Due Date either in full, equal to the Minimum Payment, or greater than the Minimum Payment. Cave Shepherd Card applies payments in order: interest charges, service fees, Cash Advance charges, then principal. Payments may be made at Cave Shepherd Card locations, Bridgetown Duty Free, One + Haggatt Hall, SurePay locations, and designated online financial institutions.
10–13. Costs, Indemnification, Online Service & Disputes
In the event of default, the Balance together with all charges becomes immediately due and payable, including collection costs. The Authorised User shall indemnify Cave Shepherd Card against any loss or claims. The Payce Digital Online Service permits viewing of transaction history and past Statements. For merchant disputes, the Authorised User shall first raise a query with the specific Merchant before filing with Cave Shepherd Card.
14–18. Offers, Personal Data, Disclosure & Privacy
Cave Shepherd Card may make special offers or extend rewards based on account management practices. Personal Data shall be retained for not less than five (5) years after termination. The Authorised User consents to Cave Shepherd Card holding and processing information electronically and/or disclosing to authorised third party providers. Communications via telephone, email or social media are not secure.
19–24. Account Closure, Termination & Governing Law
Cave Shepherd Card reserves the right to freeze or close the Account at any time if required by law, or if there are reasonable grounds to believe fraud or unlawful activity. Either party may terminate this Agreement at any time without notice; the Authorised User shall pay all Debt and return the Card. Cave Shepherd Card may vary this Agreement subject to legal or regulatory requirements. This Agreement shall be governed by and construed in accordance with the laws of Barbados.
These Terms are a legally binding agreement between you and Cave Shepherd Card (Barbados) Inc. for your use of the Payce Digital Mobile App and its Services. Use of the App requires a compatible smartphone with iOS and/or Android that enables internet access.
1–3. Introduction, Definitions & Acceptance
Cave Shepherd Card licences the use of the App and Services upon these Terms. The App is not targeted at persons under the age of 18. By using the App and Services, Users agree to be bound by these Terms, the Payce Digital Privacy Policy, and the general Cardholder Agreement.
Key definitions: "App" means the Payce Digital Mobile Application; "Account" means the Customer's registered Cave Shepherd Card Account; "Services" mean the App together with its related services and functionalities; "User" means a Customer who accepts installation of the App.
4. Minimum System Requirements
The App will only work on Eligible Mobile Devices and certain functionalities require internet connection. Cave Shepherd Card does not endorse or warrant the performance of any device. You are responsible for your device selection, operation, performance and associated costs with your internet service provider.
5. Your Use of the App and Services
You must comply with these Terms as they apply to your Account. Violations may result in termination of access. You may only use the App for personal use and must not copy, modify, extract source code, or introduce malicious material. Keep your device secure and properly close the App after each use. Keep your Card number, password, access code and CVV confidential at all times. Notify Cave Shepherd Card immediately in the event of loss, theft or compromise.
6. Transactions Using the App
Some Transactions may constitute credit funds transfers as defined by law. You may make bill or merchant payments to payees included in the Mobile App Merchant Directory. Standard limitations on transfers and bill payments apply and are fully explained on the Cave Shepherd website.
7–8. Our Responsibilities & Limitations of Liability
While Cave Shepherd Card endeavours to ensure the App is normally available 24 hours a day, access may be suspended temporarily for system failure, maintenance, or other reasons. The App is provided on an "as is" basis with no warranties. Cave Shepherd Card and its officers, directors, employees or agents are exempt from all liability for loss or damage in connection with the App, including loss of income, profits, goodwill, or data.
9–10. Risks & Indemnification
Use of the App is at your own risk. Cave Shepherd Card is not responsible for damage resulting from device malfunctions, third-party acts or omissions, services being offline, or unauthorized access. You agree to indemnify Cave Shepherd Card against all claims, demands, liabilities, costs or expenses arising from any breach of these Terms.
11–15. Termination, Charges, Modifications & Governing Law
Use of the App is at your own risk. Cave Shepherd Card is not responsible for damage resulting from device malfunctions, third-party acts or omissions, services being offline, or unauthorized access. You agree to indemnify Cave Shepherd Card against all claims, demands, liabilities, costs or expenses arising from any breach of these Terms.
